Filing a claim against title company

I filed a claim over a year ago with my title company for a

room addition that was not to code. In my title insurance,

if I am forced to remedy a structure that is not to code, my

title policy will cover up to $25,000. I filed the claim and

we went back and forth with their lawyers. They were only

willing to settle for about half of what the policy was for,

even though we had estimates for reapir that exceeded the

25,000 limit. When we advised them we did not want to settle

for less than the 25,000, they said they would not pay

anything until we were forced by the city to fix the room.

At the time we did not want to get the city involved because

we were concerned they would condemn the room and this would

cause us more hassle, especially if the title company didn't

pay right away and held it up somehow. We have since

refinanced and now have a new title company. Is our previous

title company still liabel for this claim if the city comes

out and forces us to fix it? Is there
