Legal Question in Real Estate Law in California

I'd like to know if there is anything I can do before filing a partition lawsuit against the other parties involved. A letter perhaps, to notify them that I would like to list the property as we are not on speaking terms (husband & wife)? If a letter is an option what should I indicate?

Tell them that if there is a partition lawsuit, the property will be auctioned off and the money split, and you won't get anywhere near as good a price as if the property had been sold in a regular transaction or if one party had bought out the other. Or better, pay an attorney a small sum to write the letter on his or her letterhead.
