Legal Question in Real Estate Law in California

foreclosure;

i am the new owner, i changed

the locks, previous owner wants

to get their stuff out, they have

a house full of furniture and

personal belongings, i am

allowing 5 days to remove their

things between the hours of

9am-6pm, do i need to stay at

house during ths time? and

should i have them sign

something acknowledging that

they hv access to my home

only to remove their

belongings. What r the risks I

am facing in doing this?

As I said the last time you asked, and I answered, this question, all they have to do is change the locks while you're not there and claim they are still in possession, then they can stay for 3 or 6 more months or however long it takes you to file an eviction lawsuit and have them evicted. Or they could rip out all the copper piping and sell it as scrap metal and it's your word against theirs whether there was copper piping in the house.

Maybe these are Nice People and all will go well if you lend them the keys for a week, but I think you would be taking unnecessary and foolhardy risks with desperate people who have nothing to lose -- and against whom you have no effective legal recourse if things go sour.
