Legal Question in Real Estate Law in California

Forms and procedure to evict a tennant

I need to know what form to file in the courts to have someone evicted. I would also like any info on procedures and what I need to do to have the court evict a tennant. He owes me money from over a year ago, has violated his lease by subletting and started to convert the garage to a room. I already gave him a 3day notice to pay or quit. They only gave me some of the money. He promised to pay it all by the end of the month but like usuall lied. Has not even made an attempt to pay some. Please help

Re: Forms and procedure to evict a tennant

Your local law library should have the Eviction Defense Manual or some other similar book. Nollo Press may publish a book on evictions or defending against an eviction. Either book would have a detailed description of what needs to be dome by the landlord to succeed with an eviction.

You should consider using the services of an eviction service or attorney to evict this tenant. Unlawful detainer [eviction] law is strictly construed by the court in favor of the tenant. It is very easy to overlook a step or procedure. This would result in the court dismissing the case. You would then be required to start over again. Compared to a months rent the cost of an eviction service or attorney is very reasonable and would save money in the long run.
