Legal Question in Real Estate Law in California
I gave notice 30 days before the expiration of the lease I was moving out. I asked the landlord if I could stay on one week extra. Lease expired that day. He agreed (orally). I asked him if he wanted me to pay the per diem amount for that 7 days upfront, or could he take it out of the deposit. He said, no that's fine, we can use the deposit. $200 / 30 = $6.67 daily rate. However, the landlord sends me a bill itemizing the rent owed for the 7 additional days at $22.50 per day, or nearly 4 times the monthly rate. Is that legal? at the time the ext was approved there was no mention of the higher rate

The landlord has either made a mistake, or is reaching for something he isn't entitled to. I'd discuss it with him; it isn't worth filing a lawsuit.
