Legal Question in Real Estate Law in California
Are we gonna have to pay!
We bought a duplex with our real estate agent 2 years ago.She rents the front unit out. My husband and I are on the mortgage and she is not. We are both on title. The last 2 months we have been paying the mortgage and she hasn't. Yet shes been taking the rent from the tenant. She now has a lawyer because she wants out. Our mortgage is for 625,000 and our house is maybe worth 580,000. She is asking us to buy her out for 50,000 dollars. What i want to know is if we end up going to court for a partition would the court make us sell our home even if its worth less and if that happens will we be resposible for the money thats owed or will she be responsible for half also. Would it be possible to refinance and get her off of title Without her consent. What makes a real estate partnership and is this one?

This question has been asked several times now in several ways. Hire a lawyer to help figure things out.
