Legal Question in Real Estate Law in California

Guest Parking

I live in a gated community. I own a condominium. I have heard rumors that the board has forbidden guests to park in the provided guest parking. Is this legal?

Re: Guest Parking

The condo board cannot take away an owner's property right without a meeting and a passing vote from the other owners. You have a property right in the guest parking and are allowed to use it for your guests. For the board to take that right away, there must be a good reason (such as abuse of some sort or over-use) and a formal process. Did the board follow the proper procedures for changing the guest parking rules and availability? If the board has done nothing, then you have every right to continue having your guests park in the guest parking, provided you are not abusing the spaces by over-parking or allowing extended stays.
