Legal Question in Real Estate Law in California

Hardwood Floors

Can you tell me if there a California law or statute that expressly prohibits the installation of hardwood floors on any floor other than the first?

We have someone on our board that wants to deny a new owner from putting them in, even though it is not forbidden in the CC&Rs. Only mention is to adequately sound-proof. There are other hardwood floors already in the building on several floors.

Thanks so much for your help.

Re: Hardwood Floors

Since there is no prohibition in your C.C. & R's against wooden floors and they exist already, the Board of Directors - Architectural Committee should allow them. If you call me at 714 363 0220, I will provide you with further consultation.

Re: Hardwood Floors

based on the information that you have provide, denying someone the right to install hardwood floors would help a couple of attorneys make more money.

I would suggest that they be allowed to install the floors. There is special sound pading that can be installed under such floors that will lessen any noise.
