Legal Question in Real Estate Law in California
Under the HERA ACT of 2008... FHA loans have a waiver as it relates to conveyance restrictions. The waiver is for one year. The waiver allows for a restriction to remain in force - such as a 30 day min for a lease. After a year this restriction is no longer waived. Does this mean that even though CC&Rs;state there is a 30 day min, legally it can not be enforced?
