Legal Question in Real Estate Law in California

HOA CC&R'S on boat parking.

My CC&R'S State ''No boat shall be parked on any lot except if wholly withing his garage, or common area.

Based on the above I interpretes the rule as reading that as long as the boat was wholly within my common area (side yard behing gate) it was permitted.

Any suggestions, I go in front of the board on the 22nd to plea my case.

I would need to read all of your governing documents. However, the sentence that you are questioning I would define the "lot" as your separate property, unless there is some other definition in your governing documents and your side yard in my estimation would be considered your separate property so therefore you are in compliance.

If that's all that relates to boats in the CC&Rs, I would agree with your interpretation, if my vote counts. That is, as long as it's not the Queen Mary II.
