Legal Question in Real Estate Law in California
HOA Common Area
The front area of my condominium is a ''common area,'' and is the responsibility of the HOA. I recently complained about the condition of the area, as it continued to look worse and worse. I received a letter from the HOA saying they were taking my letter ''under advisement.'' When I called to find out what that meant, they said they were deciding what to do with my yard.
One day, I believe out of spite, they came and removed all of the rocks in my yard, leaving much of the sprinkler system and many roots exposed. When I asked what more they were going to do with the yard, they said ''nothing.'' The HOA claims they had put those rocks there years ago because they had ''leftover'' rocks from an entrance project. They decided that removing the rocks would make it ''easier to maintain.'' I don't know what is easier to maintain than rocks. There will now be a weed and drainage problem.
As I stated, I believe they did this just because I complained. I also believe this has negatively affected my property value. Many neighbors have commented on how bad it looks. Do I have any recourse? Thank you.

You may have legal recourse here, but we would need more facts from you first, especially in respect to whom normally maintains the yard at issue. For a free phone consultation, contact us directly.
