HOA Dues

1) I owned a condo - rental 2) It was foreclosed on Feb 4, 2008 3) I am being sued for $ 600. for back HOA dues prior to the foreclosurer 4) I am responsible foe these dues 5) I was on the board for 3 year & we never sued any past owner in a foreclosure situation 6) Do you have any case law that I could show the Sm Claims Judge ?????

Re: HOA Dues

You are responsible for any HOA dues that acccrued prior to the foreclosure sale, i.e., before the bank or any purchaser got title at the time of the foreclosure. Whether or not the Board ever sued anyone when you were on the Board is irrelevant...in the situation you describe the HOA is within its rights to go after unapid dues.
