Legal Question in Real Estate Law in California

Our HOA of 30 homes has 1 owner who does not maintain his landscape. The board has tried fines, which he doesn't pay, legal letter threating poss. litigation and now we are considering having the HOA take over his landscaping maintenance and billing him. Is this advisable?

No, if you take over those items he will complain they were done incorrectly and willl lnot pay the Board back. Sue him in Small Claims Court, get a judgment lien against his house, and give him 30 days notice that you will seek to enforce the judgment by selling the house.
