Legal Question in Real Estate Law in California
new home builders
i have called a few new home builders and they wont work with investors. they say there are ccr's not to rent. im not looking to rent. i want to assign my contract before the close of escrow but they wont give a clear answer. can they prohibit the sale of the contract? is it discrimination if they refuse to sell to one group? thanks L

Re: new home builders
Based on the somewhat limited facts given, I'd say the builders are probably within their rights. On the other hand, California has rather broad unfair-competition laws, and there may be additional facts that would bring their rejection of your deals within one of the prohibitions of, for example, Business and Professions Code section 17200 et seq.
Re: new home builders
Investors are not a protected group for discrimination.
