Legal Question in Real Estate Law in California
We had a home built with woodside homes. At the beginning of the process the salesperson told us they were in the process of changing the color combinations of the colors on the outside of the homes. We chose a color combination that was supposed to be changed from brown trim. brown garage door and brown brickwork on the front to black. The saleswoman even pointed out a similar home that was exactly what we wanted and told us it would look that way. Now that we are at the end of our build the home has been painted exactly the way we did not want it. The salesperson is no longer with the company but we were promised something that was not given to us and we want to know if we have any recourse.

Your issue is proof. If you can prove had an agreement for a certain color combination, failure to provide it is a breach of contract which they are obligated to correct or you can sue them for the cost of having someone else do it. But it all depends on proof.
