Home loan by H1B VISA holder

i am an h1b visa holder and is married to a greencard holder. my spouse already applied for a spouse petition in order for me to have permanent residency. recently, we got pre-approved for a home loan, then we made an offer and was considered. during the escrow, the bank/lender is telling us that we cannot get the loan because i am not a permannet resident. they are only considering my wife. does the bank/lender have the rights to deny a non permanent resdient of a loan even if he has a current legal US status and residency application? please advise. thanks
