What happens if I purchace a home with out signing CC & R's the later find out I'm part of a home owners association?
What should I do?

Most likely the CC&Rs were a matter of public record (i.e., they had been recorded in the official land records of the county) when you bought the house. That put you on constructive notice that by purchasing the house you would become part of the association and bound by its rules.
That is why it is a good idea to get a title report before buying a house and review all of the items disclosed in the report so you will know what you are getting into.
You should also always buy title insurance.
