Legal Question in Real Estate Law in California

Home ownership transfer

My parents ''bought'' my house for me. I make all mortgage payments, property tax payments. It is in their name. How can I get the house put in my name? Would they need to sell it to me?

How will I get credit for the taxes?

Re: Home ownership transfer

You get the house put in your name by having your parents record a quitclaim deed to you. You can have a real estate agent do it for you, or hire an attorney. You can do it yourself if you have the proper forms and fill them out correctly. Is the loan in your name? Good Luck.

The own the house and it is up to them to deed it to you. While you are in the process of doing this, you should a contact a mortgage broker to refinance the loan in your name or see if you can assume the loan. The transer to your name MIGHT be sufficient to trigger a reassessment of the property which could mean higher property taxes if this triggers a reassessment.
