Legal Question in Real Estate Law in California
homeowners association architectural review
We had a storm and the fence between my condo and a neighbors condo was damaged. The neighbor has a little child and in my hurry due to concern for the childs safety I forgot to get an architectural review from the homeowners association. It turned out that the repairman used redwood instead of cedar wood. There was an objection from the homeowners association and I submitted an architectural review application after the fact but it has been denied. Now the homeowners association has called me for a hearing. What are my legal options so that I don't have to tear down the fence and re-do the work?

You can try to get a court to ajudicate the issue in your favor, but it is not likely and probably more that the cost of replacing the fence.

You may try submitting a Meet & Confer and possibly a waiver. You probably need a lawyer to review your governing documents to determine your best possibly solution without court intervention. Otherwise, I would expect the community to start to fine you for being out of compliance.
