Legal Question in Real Estate Law in California
about homestead over my house
My husband is disabled since 1999, we ask for a loan $25,000 before he became ill, after his surgery in both legs he is incapacited to back to work, this company give us a insurance can pay their money back in case this happens but if we send the proper doctor paperwork, which we did, back in December the account was $9.000 they ask if we can pay in full because even my husband still was ill not insurance want to cover, I explain if the payments can be less of $200 because my business is only 1 year..they promise a book with the address we need to send the payment but also new doctor evidence.. we did but they never send the book... so I think they maybe can give us a break until oiur business be around a least 2 years, but today I receive a letter a new company ask for $42.000 dollars payment...can Homestead program help us a least to start the payment the first company never send the books to start the payments? because this new company want payments around $600 or $1,000 a month which I can not do it, the homestead paper I filled up since 1999 and we have 3 children can help us? No this companies are in California

I think you need to see Legal Aid in the city or county where you live to get some advice from a lawyer who can take a half hour or so to look over your loan papers, the demand letter, etc.
If you don't speak English well, find someone who speaks your language.
Look for Legal Aid under "Attorney Referral Services" in the Yellow Pages of the phone book.
Either the homestead document you filed earlier or the automatic homestead exemption provisions of California law may help you preserve some of the equity (value) in your home.
It is difficult to give you more details from a distance. Try to find free advice in your community from Legal Aid or a similar organization.
