Legal Question in Real Estate Law in California

My husband and I bought a house but me and my dad put down the entire down payment. I need to create a contract that says if we divorce the mortgage company gets paid 1st, then my dad gets his money back, then I get my money back and then me and my husband equally divide whatever funds are left over. Do I need a lawyer to do this or can I just write up a contract and have all 3 of us sign in front of a notary?
