Legal Question in Real Estate Law in California
Illegal Eviction /Harrassment
My boyfriend has been renting from ex-inlaws for over 2 years.
His ex-wife and husband recently moved back into town and are harrassing
us (I live there also), to move out. They are leaving threatening notes
etc..and making it very difficult to live there.
The ex-father in law has nothing to say and lets his daughter continue.
Does the landlord have to pay for our moving costs, or security deposit on another
rental since he is having a family member move in? Also, the rent was $500 per month
for a 4+2+Bonus Room. The average rent for the same size home in our area
is appr. $850-$1000 per month.
No written notice has been given by the landlord.
He has 2 children and I have 1.
Thank You,

Re: Illegal Eviction /Harrassment
The owner of the property has not taken any steps to evict you. You should get a restraining order to keep the ex-wife and her husband away from the house.
Your only other choice is to move out.

If you have a lease or rental agreement for a certain length of time you are entitled to peaceful enjoyment. You can get a restraining order against the ex. If you are month to month then you can be removed with one month's notice.
The landlord is not responsible for your moving costs unless you are forced to move - but better get the restraining order first and then don't move without proof of serious harassment and violation of the order.
It is not relevant that you have a good deal on your apartment unless you are forced to leave and have time left on your lease. Then you are entitled to the difference in what you pay here and what it will cost at a new place.
