Legal Question in Real Estate Law in California
I illegally subleased part of my commercial space to a tenant for over 2 years. He found out that he was paying the rent for the entire space and decided to not pay. I issued a 3 day quit and he left. I feel he should pay the rent (3 months) that he stayed. He feels I owe him the difference. Who is right?

Just because you have a no sublease provision in your lease, doesnt mean if you do sublease, you do not have a right to rent. However, you may have to demand, and sue, to get the money. If you would like assistance, let me know. I am experienced in handling demands like this and getting payouts.
