Inherited HOA Violation

My husband and I are new owners to a townhouse that has inherited HOA problems from the previous owners. I recently found out that the architectural plans for the deck in our backyard were never submitted to our HOA. Thus we are required to submit and pay for the plan submission. Our property manager told me that the previous owners were responsible for letting us know of this shortfall during the selling/purchasing process and not the HOA. Before our escrow closed, the previous owner had paid off the violation fees but failed to let us know that the plans were still pending.

Is this a violation to the seller/buyer contract created during the sale of property?

Please advise.
