Legal Question in Real Estate Law in California

invasion of privacy?

I live in a town home that has a home owners association (HOA). INSIDE my

home i have dark red curtains, they say this does not comply to there rules of

''white'' curtains. They say to take them down or be fined. How is this legal?

How can they inforce what I have in my house. Also, the only way to see is

from the street OUTSIDE of the complex and then you can only see the top

two feet or so over the fence.

HOA's have the power to control the appearance of the community. This includes what is displayed from your windows, whether it's curtains, a sign, sticker, tinting, etc.

Read the CC&Rs and the Rules that you agreed to when you purchased your place. If it makes statements about your curtains in them, then that is what controls.
