Legal Question in Real Estate Law in California

Can a judge force you to sell a home

My ex signed an agreement he owes me $70 and would repay me by the sale of our home. He has dragge his feet and the it's upside down with negative am each month. We also have a rental home that it was agreed I would take in lieu of $$. He started keeping the rent checks now it's in foreclosre for me to deal with.

Will the judge see that he has failed to follow through with his contract, caused me financial distress and force him to sale the home?

Re: Can a judge force you to sell a home

The Court has the power, in an appropriate case, to order the sale of a home, or to require an owner to execute a deed to another person. One of the instances in which a judge might sign such an order is failure of a spouse to carry out a post-dissolution property-split judgment or the terms of a marital settlement agreement that has become part of the judgment. You should find a family law attorney with experience in carrying out judgments and orders and have him or her petition the court for appropriate further orders. Don't delay; there may be time limits on your rights.
