Legal Question in Real Estate Law in California
Can a landlord choose the rent payment method?
This is embarrassing. I'm currently into my third year of renting at this same location. During the last 27 months of rent I've bounced 5 rent checks. I have no over draft protection and one check bounced due to a couple of dollars off on my balance. Each time I've had the money needed, I either wrote the check a day early to aviod the late payment when I didn't get paid for another day thinking I would get the deposit in before the check hit my bank, that sort of thing -stupid I know. Each time however, I paid both a late fee and returned check fee equal to $55. And each time the VERY day the complex notified me of the returned check. I received a notice this month that all future rent must be made in cashiers check or money orders. Can they force me to do that by law? That would mean additional fees every month. I have never been late with the check other than those times the check bounced which was stupid on my part, but I did take care of my responsibility of paying the penalty. Please advise.

if you are on a month to month they can change any of the rental terms with 30 days notice.
