Legal Question in Real Estate Law in California

Landlord wont fix air please help!

I live in a large Apt complex. My air cond. has been broken for some time. I gave the Apt. management a letter 60 days ago stating that the AC was broken and that I had asked them on many occassions to have it fixed. I also stated that if they refused to fix it in 30 days I would have my own person do the work and subtract it from my rent. Yesterday it was in the 90s so i finally called someone to come out and fix it. Halfway through the work the Apt manager told the guy fixing my AC to leave the property and not to complete the work. I was charged $200 dollars for the work that was completed. I told the landlord that I was still going to take the money off of my rent. He said if I did he would take me to court and screw up my credit.

It is my understanding that I followed the proper procedure in this matter. If I refuse to pay my full rent can I be sued/evicted or worse?

Re: Landlord wont fix air please help!

You can always be sued, and someone can always start an eviction proceeding. However, if the unit was rented with air conditioning, you were within your rights, and the landlord would lose.
