Legal Question in Real Estate Law in California

my late mother's property

I just found out that a house that my mother used to own,was still in her name. The person to whom she said she sold it to, had apparently died. Then it went solely into my mother's name. But they failed to notify her regarding the woman's death or her interest in that home. Why was'nt she notified? And how did they sell that home, over and over, and my mother still own it? She had no knowledge of anything..Please help me..I believe that something illegal was going on!

Re: my late mother's property

If your mother sold the house, then her name should NOT have been on it, right? That means there was likely a mistake made in the drafting of the deed at the time of the sale by your mother, and the "true" owners of the deceased buyer were likely able to show escrow documentation, etc., sufficient to cause a title company to be satisfied that your mother had no ownership interest in the house. If that is what occured, then that is NOT illegal. It WOULD be illegal for your mother to have made a claim on a house she had already sold to soemone else and had already received compensation for.

The first thing to do is to check out the history of ownership on the property. Email the address to me, and I will be able to track any transactions for the last 10 years.
