Legal Question in Real Estate Law in California

Lease Breakage in this situation

Hello,

I will appreciate your help in guiding me with this situation.

I was renting a 1 bedroom apartment in Folsom, CA for which I had a 1 year lease. I vacated the apartment on March 10th, 2002 (stayed there for 6 months) and my lease is applicable till Sep 30th, 2002. The lease states that if I break the lease (which I did), I am suppossed to pay the rent of the apartment until they are able to re-rent the property. I left Sacramento because of Job Change (was very close to being laid off) and have moved to Sunnyvale, CA which is 200 miles from Sacramento. Also, they tell me that they are trying to rent it, but I am not too sure what they are doing.

I have already paid the complete March Rent and now I have been asked to pay the April rent also. What can I do in the situation. Its just impossible for me to pay the rent till September 2002 ($895/month)and bear my rent here also in Sunnyvale.

I will really appreciate your direction to get out of the situation. I look forward to hearing from you.

Regards

Sanjay

Re: Lease Breakage in this situation

You can find a renter for the place on your own. Run ad in local paper, etc.

A lease is a contract which guarantees you a place to live for a year without fear of being kicked out, and the landlord is guaranteed a renter for 1 year.

You didn't keep your end of the deal. Sorry, that's the way it is.
