Legal Question in Real Estate Law in California

Lease versus month-to-month

My son signed a lease for a condominium. The contract does imply that it is a one year lease but does not state the annual lease amount, only the monthly rent amount. Is this a month-to-month contract or a binding one year contract? I thought that a lease had to state the entire amount for the entire time the contract covers.

Re: Lease versus month-to-month

Whether the amount of rent is stated in monthly or

yearly terms is entirely irrelevant to the term of

the lease. If the lease says that the term is one

year, then it is one year regardless of the fact that

the lease prescribes the monthly rent. Whether your

son's lease is a one-year or month-to-month lease

depends on the actual language of the document. You

should have it reviewed by an attorney to determine

the answer to that question.
