leasehold land beneath condo building

owner of land has raised the rent above the cost of living index for many years. doesHOA have legal redress?

Probably; does the lease call for escalation according to the index? Read the lease, make sure you're using the right index for "cost of living" (there are several, with different formal names), and then perhaps you might sit down and discuss your views with the owner before taking stronger action? There might be a simple resolution, such as one party or the other is doing the calculations wrong, with no intent to shaft the other party.
