Legal Question in Real Estate Law in California
Legal rights of Abandoned furniture approx 3 months, 30 day notice
Elderly couple purchased sofa 4/10/05 on VISA card, delivered 6/22/05 not as agreed, wrong sofa. Return refused by store, VISA gets involved, 7/22/05 furniture store sent unqualified repair person who could do nothing because it was the wrong sofa to begin with. Furniture store never called us, when we would call, they'd leave us on hold and would not call us back. We wrote to VISA that problem was not resolved, and they credited us back the full amount. We said furniture company has 30 days from 8/1/05 to pick up and that's it. We left the country after 30 days for a trip. Come home to a message 2+ weeks after we left and furniture compnay now wants furniture back and they illegally chargeback our credit card without our authorization. Our VISA credits us back again and closes our account so the furniture store can't abuse our card. Is the furniture store entitled to the furniture after refusing to resolve this for 3 months and giving us the run around or do we own the furniture legally?

The furniture company is entitled to obtain the furniture. Not only do you have no legal right to retain it, you have no legal right to set a "time limit" for them to pick the stuff up.
