Legal Question in Real Estate Law in California

Lender put wrong city on settlement papers

I have a heloc from wells fargo , i noticed it has the city of emeryville not oakland on the settlement agreement. I live on the border but the house is in oakland. Can this error make the agreement void?

The law ignores trivialities. A minor error such as that will have no effect. If it bothers you, contact the lender to make an amendment to the settlement papers.

I doubt that this is significant enough to affect the validity of your agreement with the lender. If it is likely to cause problems with mail delivery of statements or something like this, you can go through the ordinary address-change channels to get it corrected. By the way, I have a business client with both business and personal loans with the same bank. The business moved, and all but one of the address change notices were handled properly. Getting the final one changed was a major problem. Not all their back-office people are too bright!

If there is any likelihood of a problem here, it might arise if there is also an error in the legal description of the property securing the HELOC on the note and/or deed of trust. If the error appears only on a settlement statement and not elsewhere, no big deal.
