Legal Question in Real Estate Law in California

lien assessments

Our home owners association put a lien on our property for $720. This included HOA dues, late charges, and legal fees (for the lien). We have paid all of the dues. Can we insist that the lien now be removed, even though we haven't paid the total? Our feeling is that we have paid the dues, and all that is left is administrative costs.

Re: lien assessments

Probably not; you might be entitled to a partial release, but if the costs taxed to you above and beyond the dues are legitimate, then the HOA still has a lien to the extent of the unpaid sums.

Re: lien assessments

You may insist all you want, but they do not have to release lien till paid in full including costs/fees, etc.
