Legal Question in Real Estate Law in California
I listed a house with realtor . then had double by pass, died was revived, then spent a few weeks in the hospital. During the time I was still under the effect of anathesia she proved herself to be ineffective (4 months on the market ---no offers) I have comps to show that the price was fair. I am now broke and wondering if I should rent the house. The broker has made terrible threats and the stress to me is tremendous. I bought a house from her and had to find private funding (lien on house for sale) to be until house sold. Loan is payable upon sale. The agent wanted to have access to lenders monies and emailed me (in the hospital) to make three months payments on a loan that was not due (so she could appear to be a money producer--I was scared and under the influence so I paid he. The lender , when I asked him, said it was not his idea to ask for monies that were not due, Her excuse when asked was" it was to prevent the massive interest bill and she did IT FOR ME. Then she asked my lender for a $100,000 loan---he said hell no! how can I rid myself of the this unethical bitch before I have to go back into the hospital? thanks, Greg dean

You should start by looking at your agreement with her. What have you obligated yourself to do with her? You may find that you are under no obligaton to continue to work with her, but the agreements would be the governing instruments. If you are still under contract, then determine whether there is a basis to terminate her for cause. Based on what you have described, you should locate all the operative documents, and see an attorney.
