I live in Alameda California and have been in the same building since 1993, the building is up for sale and the new owner has mentioned moving into our unit, what are our rights how long can we stay i heard its 160 days and we have to be told when the unit is in escrow we are on month to month. We also have noted mold coming thru the kids exterior bedroom wall and up the carpet. The current old owner has not fixed anything in our unit and was provided with verbal information and a written letter. We also were not informed 120 days in advance of the building being listed, i am told that refers to right to enter.

Being on month-to-month, and in the unit over a year, you have a right to 60-days notice to move out. There are different rules in some rent controlled locations, but Alameda is not rent controlled. The 120 day notice is not 120 days in advance of the listing. That notice permits them to show the property on 24 hours verbal notice, rather than requiring a written notice every time, for up to 120 days. The current owner's failure to fix things has no bearing on this situation.
