Legal Question in Real Estate Law in California
Live in a CA - 8 unit HOA condo complex. Is the HoA liable for repairing an exclusive use deck? Only 2 of the 8 u:nits have exclusive use decks. There are no bylaws regarding this. Thx

You'd have to look at the specifics of the deeded condominium to see whether the exclusive use decks are within the commons or are deeded to you. Generally, structural elements are commons and the responsibility of the HOA, but not always. The documents will control.
