Legal Question in Real Estate Law in California
I live in California and I have been living on a rental property for 2 1/2 years. I received a letter from my land lord stating that I have to pay a late for for the month of July of 6% of my rent and this was never stated to me earlier and was never in my original less. Do I have to pay this since it was never stated to me in a lease or in writing prior to her telling me I have to pay this fee?

Probably not. Landlords (and others) are not permitted to charge late fees unless (a) they bear some reasonable relation to the landlord's costs due to the late payment, and (b) the tenant has agreed to the late charges in the written lease.
