Legal Question in Real Estate Law in California

I live in a townhome where the HOA (home owners association) takes care of the water amongst other things. There has been many incidents in the 3 years I've lived here where either 1. hot water will not work, or 2. all water is turned off for several hours or even days. I've called and complained several times, which seem to fall on deaf ears. What can I do as a home owner? Can I get a petition together from the rest of the homeowners to oust the association? Can I sue for punitive damage? I've had to take time off work because of this.

The best way to try and resolve the problems that you have written about is to get a group of other property owners similarly inclined and have a meeting about the concerns with the HOA's representatives. Filing suit will most likely not get you anything of importance. The situation is an internal matter that needs to be fixed through cooperation of all home owners.
