lived at currant residence 35 yrs. we have inground pool. 6 yrs ago people behind us planted Pepper Tree. roots are beginning to raise cement around pool fear pool will be damaged. Is tree owner responsible for damages to pool?

The owner of a tree is responsible for damages caused by that tree. Pepper trees are notorious for roots that cause damage. The neighbor is responsible for damage caused to the concrete and will be for any damage to the pool. You should do something about this before the pool is damaged. It is a relatively simple repair now.
