Legal Question in Real Estate Law in California

Very long escrow request

The orig escrow was 65 days, request for 21 more days has come & gone. Yesterday we all appear in courtm they want an elisor because they claim we are not going to extend again. This is a breach of contract, quite title case, before the courts for 3 + yyrs. The house is a dump but one of the atty's has a buyer who has put 25K into some very shoddy repairs, mainly to cover up mold and other issues related. We are being told why not sign, this buyer has PERFECT high 700 credit. But if that the case why does he need until Aug 27th to close. Yesterday in court we all agreed before the judge that a pending foreclosure must be cured by July 27th. Background: We are on title, someone else has mortgage. Person who has mort. is a lieing, cheat & so is her atty. We are the only named ''sellers'' on contract but mort. holder & other are to split majority of moneys due to us being told that a settlement conf was really a Pre Trial Reddiness Conf. We agreed that 90 days if house was sold we would accept. Paperwork was all scribbled & hard to read but they got us to sign via coersion. I am even on record during that conf, trying to ask an addl question but our then atty is recorded as saying NO, no more questions! Now we might be sued again, WHAT

Re: Very long escrow request

That sounds like a very complicated story. If you do not understand what is going on and if your lawyer is unwilling or unable to provide you with a satisfactory explanation, you should probably have a full sit-down consultation with another attorney. You're looking at a few hours of attorney time to get him/her up to speed and for him/her to be able to advise you. That could easily cost you between $500 and $1,000. Depending on how much is at stake, you'll have to decide if it's worth it.

Regards,

Ben
