Legal Question in Real Estate Law in California
Mary is cutting weeds at her home with a trimmer that she purchased from a local big-box warehouse. The warehouse purchased the trimmers in bulk from a local distributor who purchased them from the manufacturer. Mary is having trouble reaching the weeds between the rocks, so she removes the protective guard from the trimmer and proceeds to trim the weeds. There are no warnings on the trimmer about removing the protective guard. While she's trimming, Mary hits a rock, which is thrown to the side, hitting her neighbor in the eye and causing permanent damage.
