Legal Question in Real Estate Law in California
Mechanic's Lien
In Sep. 07 we signed an contract and gave a cabinet maker 2,889, to start a small project. He didn't produce the product until his bond company forced him to do so, March 08. The cabinets were incomplete and not done to specs, they are so bad that it would cost more to fix than to replace. We proceeded with our claim to the bonding company, and want the contractor to come & get the product. He is now threating us with a lien to get back the money he says he has to give the bonding company. Can he put a lien on our home when he already has our money and we have nothing. Also the insurance bonding company says we are in the right and they are sending us our 2,889, because he didn't complete the contract as agreed.

Re: Mechanic's Lien
You have the right to rescind the contract and get your money back or complete the project with another contractor and sue the cabinet maker for your damages.
