Legal Question in Real Estate Law in California

Mineral Rights

What happens when you buy a piece of property that has mineral rights that are claimed by a mining company that you later find out is out of business? Do the rights automatically revert back to you or do you have to go and file for them? If you do have to file for them, where do you go and what info do you need to have? Any suggestions/help is greatly appreciated :-)

Re: Mineral Rights

I would start with a Title Company to see the state of the title as regards to the mineral rights. The rights may have been assigned to the successor in interest to the former mineral rights holder. You may wish to speak to someone in their legal department. You may have to file an action for partition. Good Luck. My office is available to assist in matters of this type. I can be reached at 408-205-5100.
