Legal Question in Real Estate Law in California
mobile mini liability
Hi, I ordered a mobile mini pod to be delivered to my house. When the driver was there he ended up wiping out my gate and a portion of my chain link fence. Since they were driving the truck and I was told that they would use their discretion as to whether or not it was safe to pull into the driveway and back out. Are they liable? They are giving me the runaround as to whether or not they are liable. the driver told me that yes they definately were while the owner is saying they may or not be. Their driver was driving the truck and caused my fence to be damaged. Are they liable for the cost of the damage? thank you

Re: mobile mini liability
Unless the gate and fence were obstructed, there is negligence on the part of the driver. The company is responsible, and they should have a liability policy that will cover your damage.

Good luck!
Re: mobile mini liability
Not only is the driver liable, the company he works for is. Demand the name of their insurance carrier and file a claim.
