Legal Question in Real Estate Law in California

Modification

Hello, I submitted my modification

paperwork to the bank a couple of

weeks ago. I have to send them a

copy of my last-year taxes, but I'm

worried because I only made

$18,000 last year. My daughters help

me out every month though with

money and that shows in my bank

statements. Today I got a call from

the bank telling me that in the end of

June/mid July they are going to put a

sale sign up on the house. I haven't

been able to pay my houe loan pymts

for 6 months now. I don't want to

loose my house. Do I still have a

chance to save it through

Modification?. What can I do?

Re: Modification

While I respect attorney Bakondi's offer, you need to be aware that if the bank is telling you it will own (and then sell) the house in June or July, then you may be too late for a loan modification. You need to meet with an attorney immediately as you are running out of time. It is not uncommon for loan modifications - even with qualified attorneys handling them - to take months, and during that time, the bank will not stop the foreclosure. If you cannot document sufficient income to service the loan, even as modified, then you may lose the home. You need to have someone qualified analyze your situation and advise you as to whether or not you should pursue this. You did not indicate where you are located, but if you are in San Diego or Orange County, you may feel free to contact me.

Re: Modification

You may send me an email, as an attorney friend of mine I have worked with in the past who does loan modifications.
