Legal Question in Real Estate Law in California

Multiple Offers - Disclosure Requirement?

We viewed a property at the same time as another couple. After they left, the agent said she would be happy to send us a pest report the next day and excused herself to get the owner to sign ''some papers.'' The next morning we found out that the other couple made an offer. Is that legal (or just slimey)?

Re: Multiple Offers - Disclosure Requirement?

Legal? Yes. Slimey? Perhaps. The agent probably hand firm offer and a bird in the hand is worth two in the bush or so the saying goes.

The agent was under no legal obligation to disclose any pending offers on the property.

If she wrote two competing offers there would be a problem, but you did not indicate that you made an offer on the property, just that you were shown the property. It sounds like someone has beaten you to the punch.

Very truly yours,
