Legal Question in Real Estate Law in California

My neighbor built a block wall on thier property, 3" off the property line. Is the 3" now considered abandoned and part of my property? Can I put stucco on the side facing my property without asking permission? What about planting vines on the wall.

No, the property is not abandoned. It still belongs to your neighbor. You need to ask permission for stucco or vines.

I agree with Whipple except about the vines. You can plant anything you want on your property. If it grows over to theirs, so be it, as long as you do not choose highly invasive plants that will damage the wall.

I disagree with Mr. McCormick. You can't plant vines on your neighbor's property, on their wall. That's trespassing.
