Legal Question in Real Estate Law in California

My neighbor is constructing a block wall and attached the wall to the exterior wall of my home without my consent. He states that it's no big deal. My HOA has not been very helpful either. What legal recourse do I have?

Your legal recourse would be a lawsuit in Superior Court for trespass to land. A cause of action (civil charge) of "private nuisance" could also be added to the trespass cause of action. Before filing suit, I'd recommend trying private negotiation or a neutral-assisted mediation process to save the expense and bad feelings of a lawsuit. One possibility might be a license for the placement of the wall on your property, which would terminate upon sale of either property.
